01 Apr What to Do if You Are Arrested for a DUI
Being arrested for a DUI can be a scary experience. If you are arrested for a DUI, it is important that you know how to respond to your arrest. Reacting properly will ensure that your penalties are kept to a minimum.
First, you should understand what constitutes a DUI in Utah. In Utah you can be convicted of a DUI if the arresting officer is simply able to show the court that you were “under the influence” of alcohol or drugs – regardless of what your blood, urine or breath alcohol test show. This means that even if your blood alcohol level is under the legal limit, but you cannot walk a straight line, you are eligible for a DUI.
When you are arrested for a DUI your license is confiscated by the arresting officer. You will have ten days to request a driver’s license hearing or you will automatically lose your license for a minimum of four mouths.
After spending the night in jail, you will be free to go but you will leave with an order to appear in court within 30 days. It is during this time period that you are expected to find a lawyer.
Often times, people that are convicted of a DUI will be required to install an interlock device on their car that will check the driver’s breath before the ignition will operate. You will be responsible for the cost of installation and the device is often required to stay in your car for 18 months.
There are a variety of funds that you can be fined if you get a DUI. Typical fines for a DUI start at $700. This fine does not include the cost of your lawyer, any court costs and a charge for the victim’s restitution fund. If you are convicted of a DUI you will not only be required to pay fines, but you will also be required to get an SR-22 and spend a minimum of two days in jail.
